All must read the following terms and conditions carefully before registering on, accessing, browsing, downloading, or using any services provided by the PayKoro website located at www.payKoro.in and all associated sites linked to payKoro.in, or the PayKoro mobile application or any similar platform on any device and/or before availing any services offered by PayKoro on the PayKoro Platform which may include services such as recharge, bill payment, gas booking,wallet service, AEPS service, money transfer, marketplace service or any other service that may be offered by PayKoro on any PayKoro Platform of website or application provided by FORMONIX COMMUNICATIONS LLP, 314-1145, Ukil Bagan, Shyamnagar, North 24 Pgs., West Bengal, Pin 743127. For the avoidance of doubt, it is clarified that these terms and conditions shall apply to allServices offered by the PayKoro website or application, or whether offered by FORMONIX COMMUNICATIONS LLP or its affiliates.
You understand that except for information, products or services clearly indicated as being supplied by Paykoro, we do not operate, control, or endorse any information, products, or services on the Internet in any way. You must understand and use Paykoro in such a way that you would not get affected in any way by Paykoro. Paykoro cannot guarantee you about the files or information available on the website of Paykoro or the application of Paykoro. Paykoro does not give any assurance about the website being virus-free or malware-free. You have the sole responsibility to keep your system out of the damage that may cause by the Paykoro website, you must get your system secure from such incident to occur.
By registering on, accessing, browsing, downloading, or using the Paykoro website or application for any services offered by us whether as a general user or as a merchant, you are bound to obey and agree to every single term and condition as described and elaborated below as well as by the service-specific terms and conditions which is applicable to each Paykoro Service. These terms and conditions should also be applicable to every possible service that may be offered by Paykoro or by an affiliated party. These Terms and conditions are also applicable to any future services that may be offered by Paykoro or any company affiliated with us in any way. By registering on, accessing, browsing, downloading, or using any service of the Paykoro application or website whether as a general user or as a merchant, it is considered that you automatically and immediately agreed to all the Terms and conditions of Paykoro. If you do not agree with any single or every term and condition, you must not use, access, download, or browse any services from our website as well as application. If you do not agree with our terms and conditions, you should immediately stop registering, using, browsing or accessing any services provided by Paykoro or any affiliated parties. Accepting or agreeing to the terms and conditions will bind you with a legal contract that will act as an agreement between you and Paykoro. You must be of minimum 18 years of age to use, or access any services by Paykoro which involve monetary transactions. It is completely your responsibility to put accurate age while registering to our website or application. The services that are available for users, merchants, or retailers, are offered, created, and serviced by Paykoro by FORMONIX COMMUNICATIONS LLP.Consequently, all the rights, benefits, liabilities, and obligations under the terms and conditions shall, as the case may be,will be beneficial or detrimental to Paykoro, regarding but not limited to recharge, bill pay, transfer, gas booking, etc., or any service related to Paykoro, or any service that will be in Paykoro in future or anytime. The Paykoro Services shall be used by You subject to Your adherence to the terms and conditions. As long as you accept and act in accordance withourterms and conditions, Paykoro grants you a personal, non-exclusive, non-transferable, non-disclosable, limited, revocable privilege to enter and use the Paykoro website or application to avail of the Paykoro Services.
Paykoro has strict eligibility criteria for users as well as for retailers. Only 18 years and above people can access any services listed in the Paykoro website and application. It is also restricted from accessing any service for those who have been suspended from Paykoro or anyone who has been removed or disqualified from availing of any Paykoro services for any reason or otherwise. This eligibility term represents an agreement and warrants that all should and must abide by the rules and regulations of Paykoro in order to use or access the Paykoro platform and become eligible users of Paykoro. With this eligibility, you have the right, authority, and capacity to enter, use and access the website and application of Paykoro. You also should not falsify any statement given by you, and not be impersonating other personalities entity in any course of action. You must state all the information accurately and properly. Misinformation, fraudulent data, and impersonating someone can lead you suspension or permanent restriction from using the Paykoro platform. Paykoro has all the rights and authority to restrict anyone or suspend anyone from using Paykoro services.
There may be other terms and conditions too, that is applied to different services that may or may not be listed in the service list of Paykoro. These services may include promotional events, promotional offers, different advertisement offers, third-party offers, etc. You agree to abide by such other terms and conditions, including that you must state your real age before using the website and if you are accessing Paykoro, you must be sure that you are at or above the legal age to participate in these types of contests or offers or any services in the Paykoro website. Any disagreement or disapproval between these terms and conditions and the terms posted for or applicable to a specific portion of the Paykoro Platform or for any Paykoro Service offered on or through the Paykoro Platform, the latter terms shall control with respect to Your use of that portion of the Paykoro Platform or the specific Paykoro Service. Paykoro may change, amend and update the terms and conditions from time to time, all must stay updated with new terms and conditions if amended. These updated terms will also be applicable to the specific services or to the portion of services offered on the Paykoro website and application. Paykoro has all rights not to update or change any terms and conditions. These terms and conditions may or may not be outdated or do not comply with services offered by Paykoro. You will have to take full responsibility to access any service offered in the Paykoro platform in that case.
All must agree to the prohibitions described below in accessing, using, or dealing with Paykoro. You must follow this in order to access all Paykoro services uninterruptedly.
• Do not try to disobey or violate any terms and conditions of Paykoro;
• Do not try to be someone other than yourself, do not try to copy or steal another’s identity, or impersonate another entity or personality, do not give false information about yourself to hide the real personality and become someone else, do not log in to other’s account by stealing other’s credentials, do not try to hack other’s account in any way;
• Do not violate or infringe the intellectual property rights of our and other third parties who are related to us or have a tie-up with our business.
• Do not try to violate anyone’s privacy or do not involve in any wrongdoings that can cause a violation of the privacy of anyone.
• Do not use abusive, coarse, offensive, vulgar, gross, or obscene language to anyone during interactions with others or during customer service conversations;
• Do not post or transmit any message, data, image, or program which is pornographic, vulgar, or offensive in nature;
• Do not try to hide or mislead Paykoro with any misinformation or false information about your identity or anything related to you;
• Do not download, transmit, transfer or copy any data or information available on the website of Paykoro or in the application;
• Do not use any third-party application or anything that could harm the security of your device as well as the security of Paykoro and that could lead to the theft of your privacy and of others as well;
• Do not try to reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of as regards Paykoro Services or Paykoro Platform or any part thereof, except and only to the extent this is expressly permissible by applicable law;
• Do not access and use the Paykoro Services or the Paykoro Platform in any wrong manner that could damage, disable, overburden, or impair it, including, without limitation, using the Paykoro Services or the Paykoro website or application in an automated manner;
• Do not modify, adapt, copy, translate, transcript, or create plagiarized works that are directly or indirectly copied from any Paykoro Services or anything that is available on the Paykoro website or application or any part thereof, except and only to the extent that this is permissible by applicable law;
• Do not intentionally or unintentionally interfere with or try to damage the operation of the Paykoro Services or the Paykoro Platform or any other user’s involvement of it, by any means, including uploading, downloading, or otherwise disseminating viruses, malware, adware, spyware, worms, or other malicious code or file with contaminating virus or malware or destructive features;
• Do not use any automated machine devices, artificial intelligence, software, or harmful code to monitor Paykoro service work or the system running Paykoro service;
• Do not try to interfere with or disrupt the connections or links that collectively runthe Paykoro Platform or networks connected to the Paykoro Platform;
• Do not take any action that imposes an unreasonably or disproportionately large load on Paykoro’s infrastructure/network;
• Do not use any device, malware, or code to bypass the Paykoro Platform’s robot exclusion headers, or interfere or attempt to interfere, with the Paykoro Services;
• Do not try to manipulate anyone or any data in Paykoro, do not try to forge any data from the website or in the website;
• Do not try to sell anything available on the Paykoro website or application as a service or as content. Anything that is available on the website or application is solely owned by Paykoro and no one has the right to download, sell, copy, transfer, or transmit anything available on the website or application;
• Do provide false, inaccurate, or misleading information while registering in Paykoro or doing anything with Paykoro;
• Do not try to harm the reputation of Paykoro using wrongful information about Paykoro;
• Do not mislead any people with wrong, false, inaccurate, incomplete, or misleading information about Paykoro;
• Do not involve in any fraud business or any fraud deal by using Paykoro;
• Do not accept money from a fraudulent source or from any illegal source. Do to transfer money to a source that is illegal and directly or indirectly involved with any antisocial activities;
• Do not use the Paykoro Services in a manner that results in or may result in reports that are negative in a fraud way, present Paykoro in the wrong way, or harm the reputation of the parent company.
• Do not try to make false payments, or try to use credit cards, or debit cards in a way that could lead to misuse of the payment system or violate the payment rules and regulations by the Govt. of India;
• Do not try or be a part of any action directly or indirectly that may cause Paykoro to lose any of the Paykoro Services from its service providers or lose any of its recharge partners or business partners, including mobile operators or telecom companies, payment processors or other suppliers;
• Do not send automated requests of any kind to the Paykoro Platform if you do not have any permission in advance from Paykoro.
The user must accept and agree to the communication policy described below.
• Be it a user or a retailer, one must accept that Paykoro may and can send different alerts related to the respective services or push notifications for different activities related to the services available in the Paykoro platform to the device that is being used for Paykoro services. Paykoro may send an SMS (short message service) to the number that has been used to register to the Paykoro platform as a user or a retailer for different purposes, but not limited to the services and promotional purposes from the Paykoro platform. Paykoro may send OTPs to the number you provided during the registration for activation purposes and other service-related updates. Paykoro may send push notifications to the device that has been used to register on the Paykoro platform or to access the services offered by Paykoro and different purposes. Pay Koro may send an e-mail to the registered email id with your account for many purposes like identity confirmation, OTP verification, promotional updates, service-related updates, or ad-related mail.
• Paykoro makes the best efforts to send you messages, emails, or push notifications for sake of the betterment of Paykoro services. Though Paykoro cannot guarantee anyone that they will get such services. Paykoro cannot send messages to a number that is out of network reach, switched off, or disabled or the number that is blocked or unsubscribed to the SMS service of Paykoro. Paykoro cannot send you push notifications to the device if you disable the notification option for the Paykoro application or website. In order to get a push notification from the browser you must opt for yes when a confirmation notification floats to the website. Paykoro cannot send push notifications to a device that is switched off, not functional, or has no connection to the internet services. Paykoro cannot send you e-mails to the mail id if you provide the wrong email id, the email id is not valid, the email service is not operational anymore, the server of the email is not operational anymore, or the email id is deactivated. Paykoro cannot send you emails if you block the Paykoro email provider or unsubscribe to the email services provided by Paykoro.
• Paykoro will try every possible way to provide alerts via SMS/e-mail/push notifications to the users and retailers and it shall be deemed that you shall have received the information sent from Paykoro as an alert on the mobile phone number or e-mail id provided during the course of, or in relation to, using the Paykoro Platform or availing any Paykoro Services as a user or a retailer. Paykoro shall not be under any obligation to confirm the authenticity of the user(s) or retailer(s) receiving the alert. Paykoro cannot guarantee and is not responsible in any manner for any non-availability of any alert services or if you don’t get any SMS, email alert, or push notifications.
• You must acknowledge that you have agreed and accepted that Paykoro has the authorization to send you different alerts and that Paykoro can contact you through email, call, SMS services, or chat services on the website of Paykoro. You further authorize Paykoro that Paykoro can send you messages and can call your number to communicate with users and retailers if needed overriding DND services if you activated it in case.
• Paykoro is not liable for the errors in the alert’s services. Paykoro cannot stand accused of fraud alert services or any inaccurate notification services. Paykoro is not responsible for any wrongful thing that may or happened to the users or retailers or any financial loss suffered by the users or retailers for the alert services by Paykoro. Paykoro notifications, SMS or email can have errors in them. Users and retailers must respond to the alerts using their own credibility. Paykoro cannot guarantee you virus-free or error-free email services. Paykoro can be stood accused if your devices suffer any loss or damages that may have been caused by Paykoro or any third-party websites that are linked with Paykoro’s website and application.
• Paykoro cannot guarantee the clarity, readability, accuracy, and promptness of providing the SMS/e-mail alert/push notification service depending on many factors including the device status, network connectivity, or the alert service providers. Paykoro is not responsible if you get incomplete alerts, distorted alerts, or inaccurate alerts. Paykoro is also not responsible for delayed alert reception or non-delivery of any alerts in any way whatsoever.
• You will not accuse and hold responsible Paykoro Platform or the Parent company and the SMS/e-mail service provider including its officials for any damages, claims, demands, legal proceedings, losses, costs, charges, and expenses whatsoever including legal charges and attorney’s fees which Paykoro or the SMS/e-mail service provider may at any time incur, sustain, suffer or be subjected to as a consequence of, or arising out of, any of the following:
(i) Using Paykoro in an illegal way;
(ii) Providing improper or fraudulent information;
(iii) Providing an inaccurate number while registering to the Paykoro services or a number that belongs to another entity;
(iv) you being a retailer give customers wrong booking number, false train number, false bill payment receipt or denying any cancellation fees or refunds of any services by the Paykoro that have been availed and further canceled by the consumer.
Paykoro has all the rights to suspend, terminate or delete your account and can bar you from using any Paykoro services as a user or a retailer without any reason and at any time. Paykoro can suspend your account temporarily or permanently Paykoro thinks you are misusing the platform, involved in illegal activities, using Paykoro in any anti-social work, using Paykoro to fraud anyone, or misleading anyone with any wrong and inaccurate information whatsoever. Paykoro can delete your account if you have given false information about yourself while registering on Paykoro or trying to be someone other than you by providing someone else’s information. Paykoro can delete any user’s or retailer’s account without any prior notice. You must agree that Paykoro is not liable for any loss, damages, or any suffering that may happen after the termination of your account or in the future for the termination. After the termination, suspension, or, deletion of your account you must stop using Paykoro immediately.
Your personal information, information about your account, and other information are stored safely in the database of Paykoro. Though that database is very safe and secure, still there is the probability that we can lose your data partially or completely for some unavoidable and unwanted circumstances like hacking, malware attacks, the act of GOD, etc. We may ask you for such lost information many times in order to keep your account operable. You must provide proper information while we ask to confirm your identity. Paykoro will not be liable for such data loss.
Paykoro is not liable to anyone for any loss, damage, or theft of information which may or may not have occurred during the course of including but not limited to registration, using any service, or dealing with Paykoro. You cannot hold Paykoro responsible for any direct, indirect, circumstantial, consequential, evidential, or exemplary monetary loss, loss of profits, loss of incentives, loss of revenues, or any financial damage that may have occurred by using Paykoro or any third-party platform that is linked with Paykoro.
Paykoro is not liable for any losses that may cause for the malfunctioning of the Paykoro website or application of Paykoro.
Paykoro cannot be responsible for any loss of monetary transaction that may cause due to any glitch in the server of the banking sector.
Paykoro cannot be held liable for any loss that may occur during the transfer of money or paying bills for different sectors due to any network error.
Paykoro is not responsible for any financial loss of wallet money that may cause due to database error.
Paykoro is in no way responsible for the damages that may have occurred to your device for using the Paykoro website or application
There is no way that, Paykoro, its Owners, employees, or agents will be liable to any user or retailer for any damages, liabilities, losses, and causes of action arising out of or relating to any of the following:
1. The agreement between Paykoro and users or retailers, or anyone who is accessing Paykoro;
2. The service that is available on the Paykoro website or application;
3. Any third-party platform that is linked to the website of Paykoro;
4. Inability to use the Paykoro website or application due to any cause;
5. Inability to access any service offered by the Paykoro platform due to any problem caused by you;
6. Malfunctioning of the application or website due to any accidental touch or wrong key press;
7. Or any other damages suffered by any user or retailer by accessing the services offered by Paykoro.
Paykoro has set some limitations on use, you must agree to these limitations and agreement to access the services offered by Paykoro. Paykoro cannot give you any service without these limitations and these limitations are set by the directors of the company and the legal authority of Paykoro. Applicable law may not completely allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitations or exclusions will apply to you subject to applicable law. In such cases, Paykoro’s liability will be limited to the fullest extent permitted by applicable law. This paragraph shall survive the termination of this Agreement.
Paykoro cannot give you any compensation for the loss or damages that may have occurred during the course of including but not limited to using, downloading, or accessing any services offered by the Paykoro platform. You agree and accept the term that you will recompensate Paykoro, its affiliates, employees, officers, directors, and partners harmless from any and all claims, losses, damages, liabilities, costs, and expenses, including without limitation legal fees and expenses, arising out of or related to:
(i) your use of any Paykoro service or dealing with Paykoro;
(ii) violation or any terms and conditions; or
(iii) breaching of any contract or agreement between you and Paykoro,
(iv) doing any illegal activities using Paykoro services. Paykoro will make every effort to get you any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of this Agreement.
Paykoro disclaims all warranties or guarantees – whether statutory, express, or implied – including, but not limited to, warranties of any service, merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. Paykoro will not entertain any written or verbal information or advice in any way, no matter whether you got it from the Paykoro platform or you received it during any access to the service offered by Paykoro. Paykoro simply disclaims all the written or verbal warranties or any promises that may or may not have been made. Paykoro disclaims all the warranties or offers that are promised by any third-party merchant who is a partner of Paykoro. Any information provided by third-party services like recharge, bill payment, ticket booking, etc. has no warranties by Paykoro. Paykoro cannot guarantee you the third-party services that you may have purchased through Paykoro, Paykoro works just as a bridge or middleman for these types of third-party services. Paykoro cannon assure you about the safety of the money that you have transferred to any account through AEPS or wallet transfer. The Services offered by Paykoro and the Paykoro Platform and any written information, third-party service provider, linked websites, linked services, or any services that may be offered by Paykoro in the future are provided on as its and as is written basis and without warranties or representations of any kind either express or implied. Paykoro does not warrant that the information, Paykoro website or application, functions, services, or any other information offered on or through the Paykoro website or application or any other sites that may have a link with Paykoro will be uninterrupted, or free of errors, viruses or other harmful components and do not warrant that any of the foregoing will be corrected in any time. You must acknowledge the risk of agreeing to and accepting the terms and conditions of Paykoro and further accessing, browsing, downloading, or using any services of Paykoro. You must acknowledge that Paykoro is in no way responsible for any direct, indirect, consequential, or incidental financial loss or any losses that occurred during the use of Paykoro and the damages suffered by you due to that loss.
Paykoro can and will review and update the terms and conditions from time to time. Users or retailers must stay updated with the terms and conditions. All must agree to and accept the new terms and conditions in order to access any service by Paykoro. Paykoro can change, rewrite, delete or modify any terms and conditions with the course of the changes in the website or application or with the changes made in the operations of Paykoro. When you access, download, or use any services by Paykoro or any way related to Paykoro, it will be considered that you have accepted the new terms and conditions. One must stop using Paykoro immediately if he/she does not agree to or accept the updated terms and policies.
If you have any issues or disagreements with the terms or anything related to the Paykoro platform you can always reach out to our grievance cell. Any complaints about our work ethics, rude behavior, or misbehavior will not be tolerated by the grievance cell. Any service-related complaints will be resolved within 30 days of registering the complaints.
